This seminar will examine the basic ideas behind the "structuralism" expounded in the book "From Apology to Utopia. The Structure of International Legal Argument" (1989/2005). He hopes to restate the two objectives of critical legal research of the exercise of power through analysis of (legal) language. First, he will show how the work provides an account of international legal "competence" as the ability to use language in ways that appear persuasive in contexts where lawyers operate. The sense of "persuasiveness" has to do the way lawyers are trained to follow a tightly structured but substantively indeterminate system of argument. In addition to providing a view of jurists¿ specific "competence", he suggests that a structural analysis also operates as a legal and political critique of (international) law by revealing its empowering and enchanting effect. The main point has to do with the continuing power of structuralism as a form of legal analysis and critique.
